Subscription Terms for Yerbu

1. About Yerbu

Yerbu is a web-based subscription service for the administration, delivery and analysis of assessments and tests.

By ordering or using Yerbu, the customer accepts these subscription terms.

2. Target group

Yerbu is primarily developed for Norwegian businesses, organisations, educational institutions and other professional entities. The agreement is entered into between Norsk Test AS and the customer as a legal entity.

3. Subscriptions and pricing

Current subscriptions, features and prices are available on Yerbu's website and order form. All prices are quoted in Norwegian kroner (NOK) excluding VAT unless otherwise stated.

Yerbu is offered in the following subscriptions: Pilot, Start, Standard, Professional and Enterprise.

Norsk Test AS reserves the right to change prices and content for new subscriptions.

4. Pilot subscription

The Pilot subscription is intended for evaluation of Yerbu before entering into a regular subscription. The Pilot subscription: is valid for 45 days from activation, is not renewed automatically, and expires automatically at the end of the period. For continued use, the customer must order a regular subscription.

5. Ordering

Orders are placed via Yerbu's website or by agreement with Norsk Test AS. The customer is responsible for ensuring that the information provided is correct. Norsk Test AS reserves the right to reject orders where there is reasonable cause.

6. Payment

Subscriptions are invoiced monthly in advance. Invoices are sent to the specified invoice recipient or invoice email address. Standard payment terms are 14 days. Norsk Test AS may conduct a credit assessment before activation.

7. Activation

Access to Yerbu is normally activated within 1–2 business days after the order is confirmed. Where customisations or special setup are required, activation may take longer.

8. Subscription period

Start, Standard and Professional are ongoing subscriptions billed monthly. The subscription runs until terminated in accordance with the cancellation terms. Enterprise subscriptions are governed by a separate agreement.

9. Cancellation

Start, Standard and Professional have a mutual notice period of 3 months. The notice period is calculated from the first day of the month following receipt of written notice. Notice of cancellation must be sent to post@norsktest.no. The subscription and billing continue throughout the notice period. No refund is given for periods already commenced.

10. Support and follow-up

The customer receives support and follow-up in accordance with the chosen subscription. Support may include technical assistance, user support, and guidance on use of the service. The scope of support and follow-up varies between subscriptions.

11. AI features

Yerbu may include AI-based features. Results generated using AI should always be assessed and quality-assured by the user before use. Norsk Test AS may impose limitations or quotas on AI features where necessary for technical or economic reasons.

12. Availability and operations

Norsk Test AS aims for high availability of the service. Planned maintenance is normally carried out outside regular working hours. Temporary interruptions may occur as a result of maintenance, error correction or circumstances beyond the control of Norsk Test AS.

13. Customer data and personal data

The customer retains ownership of their own data entered into Yerbu. Norsk Test AS processes personal data in accordance with applicable data protection legislation and the company's privacy policy. Where required by the processing, a data processing agreement will be entered into between the parties.

14. Late payment

In the event of late payment, Norsk Test AS may suspend access to the service until the outstanding amount is paid. Late payment interest and any charges are calculated in accordance with applicable regulations.

15. Price changes

Norsk Test AS may adjust subscription prices. Existing customers will be notified at least 30 days before price changes take effect.

16. Limitation of liability

Norsk Test AS is not liable for indirect losses, including lost profits, lost revenue, lost data or other consequential damages arising from use of the service. Norsk Test AS's total liability is limited to the amount the customer has paid for the service in the last 12 months. This limitation does not apply where the loss is due to gross negligence or wilful misconduct.

17. Changes to the service

Norsk Test AS may further develop, improve and change the functionality of Yerbu. Significant changes that affect customers' use of the service will be communicated as far as is practically possible.

18. Governing law and disputes

These subscription terms are governed by Norwegian law. Disputes that cannot be resolved amicably shall be dealt with by the ordinary courts, with Øst-Finnmark District Court as the venue, unless otherwise required by mandatory legislation.
